Terms & Conditions

Tabarak Pharmacy Mobile App
Last updated: October 2026

1. Acceptance of Terms

These Terms & Conditions ("Terms") govern your use of the Tabarak Pharmacy App and the services offered through it. By downloading, registering or using the App you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the App.

2. About Us and Licensing

The App is operated by Tabarak Pharmacy W.L.L., Commercial Registration No. 12750601, a pharmacy licensed by the National Health Regulatory Authority (NHRA) under licence No. 32000185. All medicines are dispensed under the supervision of a licensed pharmacist registered in the Kingdom of Bahrain.

3. Eligibility and Your Account

  • You must be at least 18 years old and legally capable of entering into a contract.
  • You must give accurate, current and complete information and keep it updated.
  • You are responsible for all activity on your account and for keeping your login details confidential.
  • We may suspend or close accounts that provide false information, breach these Terms or are used for fraud or abuse.

4. Our Services

Through the App you may, subject to availability and Bahraini law: browse and order over-the-counter medicines, health and personal care products; submit prescriptions for dispensing; request refills; choose home delivery or branch pickup; and contact our pharmacists. Product images and descriptions are for guidance only and packaging may differ.

5. Prescription Medicines and Health Information

  • Prescription-only medicines are dispensed only against a valid prescription issued by a doctor licensed in Bahrain (or otherwise accepted under Bahraini regulations). We may ask to see the original prescription at delivery or pickup.
  • Our pharmacists may contact you, contact the prescriber, adjust or decline a request, or refuse to dispense if they believe it is unsafe, unlawful or the prescription is invalid, expired or suspicious.
  • Controlled and psychotropic medicines are subject to strict legal rules. They may not be available through the App or for delivery, and may require collection in person with identification.
  • We cannot supply medicines that are unlawful or restricted in Bahrain.
  • Information in the App, including any chat or advice, is general and does not replace advice from your doctor or pharmacist. Always read the leaflet and follow your doctor’s instructions.
  • In an emergency, call 999 or go to the nearest emergency department. Do not use the App.
  • You must tell us accurately about allergies, current medicines, pregnancy and relevant conditions. We are not responsible for harm resulting from incomplete or incorrect information you provide.

6. Orders and Acceptance

Placing an order is an offer to buy. A contract is formed only when we confirm the order and, for prescription items, our pharmacist approves it. We may cancel or limit an order if an item is out of stock, mispriced, restricted, or if we suspect fraud. If we cancel after you have paid, we will refund you.

7. Prices and Payment

  • Prices are in Bahraini Dinar (BHD) and include or exclude VAT as shown at checkout (VAT at the rate applicable in Bahrain).
  • Prices of regulated medicines follow the prices set by the competent authority.
  • Payment methods: Cash on Delivery (COD), T-wallet, Smiles points, BenefitPay (BP), and other supported payment gateways. Card and online payments are processed by third-party providers and are subject to their terms.
  • Delivery fees, if any, are shown before you confirm.
  • If a payment fails or is reversed, we may cancel the order.

8. Delivery and Pickup

  • We deliver across all regions in Bahrain. Delivery times are estimates and not guaranteed.
  • Someone aged 18 or over must receive the order. For prescription medicines, the recipient may be asked for identification.
  • If no one is available after reasonable attempts, we may return the order to the pharmacy. We may charge redelivery fees and, for medicines that cannot be restocked, may not refund.
  • Risk passes to you on delivery. Please check your order on receipt and report any problems immediately.
  • Medicines that require special storage (for example, refrigeration) are delivered with appropriate packaging, but you must store them correctly upon receipt.

9. Returns, Cancellations and Refunds

For safety and legal reasons, medicines and many health products cannot be returned or exchanged once they have left the pharmacy, except where:

  • we delivered the wrong item, a damaged or defective product, or an expired product; or
  • the law requires otherwise.

Report such problems within 48 hours of receipt, with photos and the original packaging, through the App or at Tabarakph.info@gmail.com. If approved, refunds are issued directly to your T-wallet or within 3–7 working days on cards if you do not accept a T-wallet refund. You may cancel an order before it is prepared or dispatched. Orders already prepared or containing prescription items may not be cancellable. Nothing in this section limits rights you have under Bahraini consumer protection law.

10. Product Recalls

If a product is recalled by the manufacturer or a health authority, we may contact you using your registered details. Please follow the instructions in the recall notice.

11. Acceptable Use

You agree not to:

  • upload forged, altered or someone else’s prescription without authority;
  • order medicines for resale, misuse or in quantities beyond reasonable personal or family use;
  • use the App for unlawful, fraudulent or abusive purposes;
  • interfere with the App’s security or operation, reverse engineer it, scrape data or use bots;
  • impersonate another person or misuse another person’s account;
  • upload malicious code or unlawful content.

We may report suspected unlawful activity, including prescription fraud, to the competent authorities.

12. Intellectual Property

The App, including its software, design, trademarks, logos, text and images, belongs to Tabarak Pharmacy or its licensors and is protected by Bahraini and international law. We grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the App on your device for its intended purpose. You may not copy, modify, distribute or exploit any part of it without our written permission.

13. Loyalty Programmes, Offers and Promotions

If we offer points, vouchers, or discounts (including Smiles points), they are subject to the specific terms shown with the offer, have no cash value unless stated, may be changed or withdrawn, and may not apply to prescription or price-regulated medicines where the law restricts discounts.

14. Availability and Changes to the App

We aim to keep the App available but do not guarantee uninterrupted or error-free service. We may update, suspend or discontinue features for maintenance, security or legal reasons. We may change these Terms; material changes will be notified in the App, and continued use after the effective date means you accept them.

15. Disclaimers and Limitation of Liability

To the maximum extent permitted by Bahraini law:

  • The App and general information are provided "as is" and "as available".
  • We are not liable for indirect or consequential loss, loss of profit, or loss caused by events beyond our reasonable control (such as network outages, strikes, supply shortages, severe weather or government action).
  • We are not liable for harm caused by information you gave us that was inaccurate or incomplete, or by your failure to follow a doctor’s or pharmacist’s instructions or the product leaflet.
  • Our total liability for any claim relating to an order is limited to the price you paid for that order, except where liability cannot be limited by law.

Nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud, or any liability that cannot be excluded under Bahraini law, and nothing affects your mandatory consumer rights.

16. Indemnity

You agree to compensate us for losses we suffer because of your breach of these Terms or your unlawful use of the App, to the extent permitted by law.

17. Termination

You may stop using the App and delete your account at any time (Settings > Account, or by contacting us). We may suspend or terminate your access if you breach these Terms or if required by law. Clauses that by nature should continue (such as intellectual property, liability and governing law) survive termination. Some data must be retained after closure as described in our Privacy Policy.

18. Complaints

If you have a complaint, contact us at Tabarakph.info@gmail.com or +973 33866650. We will try to resolve it promptly. You may also contact the Consumer Protection Directorate at the Ministry of Industry and Commerce, or the NHRA for matters concerning pharmacy practice or product safety.

19. Governing Law and Jurisdiction

These Terms are governed by the laws of the Kingdom of Bahrain. The courts of Bahrain have exclusive jurisdiction over any dispute, without prejudice to any mandatory right you have to bring a claim elsewhere under applicable law.

20. General

  • Entire agreement: these Terms and the Privacy Policy are the whole agreement between you and us about the App.
  • Severability: if any provision is found invalid, the rest remains in force.
  • No waiver: failure to enforce a right is not a waiver of it.
  • Assignment: you may not transfer your rights under these Terms; we may transfer ours to a successor business.
  • Language: these Terms are provided in English and Arabic. In case of any conflict, the Arabic version prevails.
  • Electronic acceptance: your acceptance in the App has the same effect as a signature under Bahraini electronic transactions law.
